"Since we filed the lawsuit against Ellie Mae on May 4, 2004, the suit has continued to progress, leading to the recent decision by Judge Illston to permit Calyx to file a second amended complaint. However, during this time, Ellie Mae has continued to put out fundamentally wrong information in the media and the mortgage market in general. Starting in June, Ellie Mae has been saying that the law suit has been dropped. This is not the case, and has never been the case. The only reason we are releasing this press release is to clear up the wrong coming out of Ellie Mae, including demanding they remove an article from their website that they know fully well is incorrect, stating that the lawsuit had been dropped.
