Court Grants Calyx Software Right to File Second Amended Complaint Against Ellie Mae for Copyright Infringement and Unfair Competition - 9/14/2004
 

San Jose, CA- September 13, 2004 - Calyx Software announced today Friday's decision by United States District Judge Susan Illston to permit the company to file a second amended complaint against Ellie Mae for copyright infringement and unfair competition. The amended complaint elaborates on Calyx's allegation that Ellie Mae deliberately copied Point's screens when creating its new Encompass program in order to trade on Calyx's trade identity and good will, and also includes an additional count of unfair advertising.

In its decision, the court stated that Calyx had sufficiently plead that the screen displays in its software had acquired "distinctiveness" and that Calyx had sufficiently met the distinctiveness requirement for a trade dress cause of action.

Calyx Software filed a lawsuit against Ellie Mae on May 4, 2004, alleging copyright infringement, false designation of origin, and violations of the California Unfair Competition laws.

"Since we filed the lawsuit against Ellie Mae on May 4, 2004, the suit has continued to progress, leading to the recent decision by Judge Illston to permit Calyx to file a second amended complaint. However, during this time, Ellie Mae has continued to put out fundamentally wrong information in the media and the mortgage market in general. Starting in June, Ellie Mae has been saying that the law suit has been dropped. This is not the case, and has never been the case. The only reason we are releasing this press release is to clear up the wrong coming out of Ellie Mae, including demanding they remove an article from their website that they know fully well is incorrect, stating that the lawsuit had been dropped. We will continue to pursue this legal action against Ellie Mae in order to protect our intellectual property," said Dennis Boggs, Senior Vice President of Business Development at Calyx Software.
